The Extradition Clause or Interstate Rendition Clause of the United States Constitution is Article IV, Section 2, Clause 2, which provides for the extradition of a criminal back to the state where they allegedly committed a crime.

The Extradition Clause provides for the return of persons charged with a crime in one state who fled to another state. In some ways, the extradition clause was the mirror image of the Privileges and Immunities Clause.

Another way of preventing extradition is by challenging the arrest based on probable cause. In many instances this is applicable if the alleged fugitive was not indicted or convicted in the demanding state (no prior judicial determination as to probable cause in the demanding state).

This is established in Article 69 of the Constitution of the Bolivarian Republic of Venezuela, which prohibits extradition of Venezuelans.

No country in the world has an extradition treaty with all other countries; for example, the United States lacks extradition treaties with China, Russia, Namibia, the United Arab Emirates, North Korea, Bahrain, and many other countries. There are two types of extradition treaties: list and dual criminality treaties.

In extradition proceedings, in general Greece does not extradite a person who was a Greek citizen when the offence was committed or is a Greek citizen when the request is made.

The United States and the United Kingdom have long had a bilateral extradition relationship. That relationship is currently governed by an extradition treaty signed in 2003.

Section 14 of the Extradition Act 1965 prevents the extradition of an Irish national unless the relevant extradition treaty or arrangement provides otherwise. For example, treaties with the United States and with Australia apply to Irish citizens or nationals.

That Dáil Éireann approves the terms of the Treaty on Extradition between Ireland and the United States of America signed in Washington on 13th July, 1983. The treaty was again laid before the Dáil on 24 October 1986.
